1. Acceptance of Terms
By downloading, accessing, or using the Maximus AI mobile application and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
2. Description of Services
Maximus AI provides a mobile-first AI assistant that offers voice interaction, intelligent scheduling, business discovery, personalized recommendations, and productivity insights. Our Services are powered by the Olympus Cloud platform.
3. Account Registration
To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Transmit harmful, threatening, abusive, or harassing content
- Attempt to reverse-engineer, decompile, or extract the AI models
- Use the Services to generate content that violates third-party rights
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to any systems
- Resell or redistribute access to the Services without authorization
5. Subscriptions and Billing
The Free tier is available at no cost. Paid plans (Pro, Premium, Business) are billed monthly or annually through your app store account or directly via credit card. All fees are non-refundable except as required by law or app store policies. We reserve the right to change pricing with 30 days notice.
6. Intellectual Property
The Services, including all software, designs, voice packs, AI models, and content, are owned by Maximus AI and protected by intellectual property laws. You retain ownership of your personal data, calendar entries, and conversation content. You grant us a limited license to process your data solely to provide the Services.
7. AI-Generated Content
The Services use AI to generate responses, recommendations, and scheduling suggestions. AI-generated content is provided "as-is" and may contain errors. You are responsible for reviewing and verifying any AI-generated content before relying on it for important decisions.
8. Data and Privacy
Your use of the Services is also governed by our Privacy Policy. You are responsible for ensuring that any data you provide complies with applicable privacy laws.
9. Service Availability
We target 99.9% uptime for our Services. Occasional downtime may occur for maintenance or updates. We will provide advance notice for planned maintenance when possible.
10. Limitation of Liability
To the maximum extent permitted by law, Maximus AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or business opportunities arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
11. Termination
You may delete your account at any time from the app settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will make your data available for export for 30 days following termination.
12. Modifications
We may update these Terms from time to time. Material changes will be communicated via the app or email with at least 30 days notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
